Swiss tenancy law sets a federal framework, but the paper trail also depends on the canton and contract. The most important checks are how rent is split, where the deposit is held, which dates control notice, and which official form applies at the property's address.
What must the contract tell you?
Identify the tenant, landlord, exact home, included rooms or parking, start date, contract duration, and permitted use. Separate net rent from Nebenkosten in German or charges in French, meaning service and building costs. The agreement should show which items are included and whether you pay a fixed amount or an advance later reconciled with actual eligible costs.
Read every rent-adjustment clause. The Referenzzinssatz is the official mortgage reference rate used in rent adjustments. The Federal Office for Housing publishes it, and changes can support an increase or a tenant's reduction request, subject to the contract and other cost factors. It is not the Swiss National Bank policy rate, and a policy-rate announcement does not change the rent automatically.
Some cantons require an official form when a new tenancy's initial rent is notified during a recognised housing shortage. The form can show the previous rent and the reference-rate and consumer-price basis. This requirement is cantonal, may cover all or only part of a canton, and can change with local rules. Check the current Federal Office for Housing list for the address.
How is the residential deposit protected?
Article 257e of the Swiss Code of Obligations caps security for residential premises at three months of rent. A Kaution in German or garantie de loyer in French means this rental deposit. When the tenant provides money, the landlord must place it in a savings or deposit account at a bank in the tenant's name.
That account is often called a Mietzinsdepot, meaning a blocked rental-deposit account. The bank releases it with both parties' consent or on the basis of a final payment order or court judgment. If the landlord has not brought a legal claim against the tenant within one year after the tenancy ends, the tenant can ask the bank to return the security. Keep the account-opening document and never treat an ordinary transfer to the landlord as equivalent protection.
Which dates and records control a dispute?
An Übergabeprotokoll in German or état des lieux in French means the condition report at handover. List defects, meters, appliances, furniture, and every key, with dated photographs. Repeat the process at move-out. The two records help separate tenant-caused damage from existing defects and ordinary wear.
Do not assume you can leave on any month-end. The contract, statutory minimum notice, and locally customary termination dates can work together. Send notice in the required written form early enough to arrive on time. Swiss rules can allow an early release when you propose a suitable, solvent replacement tenant willing to take the lease on the same terms, but evidence and timing matter.
For a rent, deposit, notice, defect, or termination disagreement, use the Schlichtungsbehörde in German or autorité de conciliation in French, meaning the rental conciliation authority. Swiss civil procedure normally starts tenancy disputes with this local conciliation stage before a court case. The competent office is based on the property location.
Common misconceptions
The three-month ceiling does not authorise a landlord to keep cash in a personal account. The legal maximum and the protected account rule are separate safeguards.
An official initial-rent form is not universal across Switzerland. Federal law permits the requirement, while cantonal housing-shortage rules decide where it applies.
