Signing an Austrian lease is a cash event as much as a housing event. Kaution plus first Warmmiete can dwarf one month of headline Kaltmiete before you unpack. Which rules apply depends on whether your flat sits in the Vollanwendungsbereich (full application), Teilanwendungsbereich (partial application) or outside the Mietrechtsgesetz (MRG).
What belongs in the written Mietvertrag?
Use a clear Mietvertrag (rental contract). Confirm the exact address, Kaltmiete (cold rent), Betriebskosten (building operating costs), heating arrangement, start date, and whether the lease is unbefristet (open-ended) or befristet (fixed-term). Fixed-term residential leases commonly need a minimum duration pattern under MRG practice; if a supposed fixed term is invalid, stronger tenant protection can apply. Ask for every verbal promise in writing.
Confirm Meldezettel rights before you celebrate. City of Vienna guidance requires registration within three days of moving in, with the Meldezettel form signed by you and the housing provider. How do Kaution and Betriebskosten work?
Kaution is the security deposit. In full-MRG tenancies, § 16b MRG caps it at six months' gross rent (Hauptmietzins including Betriebskosten and VAT where applicable). Market practice often sits around two to three months' gross rent. In partial or non-MRG cases the statutory six-month ceiling may not apply the same way, so read the contract and get advice if the demand looks extreme. Ask whether the money is held segregated and how interest is handled on return.
Betriebskosten cover shared building costs such as cleaning, waste, caretaker and common utilities. They are usually paid as monthly advances and settled later. Do a written handover inventory with photos on move-in day. Without that record, exit deductions for "damage" become harder to challenge. Mietervereinigung or Arbeiterkammer advice helps when a clause looks off; Vienna also runs Schlichtungsstelle mediation routes for many rent disputes.
Genossenschaft Finanzierungsbeitrag is not the same as Kaution. Cooperative entry capital follows Wohnungsgemeinnützigkeitsgesetz rules and a different repayment logic when you leave.
Common misconceptions
Bestellerprinzip on Makler fees does not cap or replace Kaution. Broker rules and deposit rules are separate pots.
A low Kaltmiete is not a low housing cost if Betriebskosten and heat are large. Always total Warmmiete.
