What should the lease contain?

How does Finanças registration protect the paper trail?
Landlords must communicate leases, changes, and termination to the Tax Authority. Portal das Finanças provides the contract and electronic rent-receipt services. The Stamp Duty Code also allows tenants to communicate a lease when a landlord fails to do so, under the applicable process.
Check your Portal das Finanças account after signing. Keep electronic rent receipts and bank-transfer records. Cash without a clear receipt weakens proof of payment and can create problems when the lease is needed as address evidence.
Registration does not prove that every contract clause is fair. It proves the tax record and payment trail, which is only one part of tenant protection.
How do you protect the deposit?
Attach an inventory with photographs, meter readings, keys, furniture, appliances, and existing damage. Both sides should receive the same dated version. Report defects in writing soon after move-in.
Before leaving, follow the notice clause, settle documented bills, clean the agreed items, and repeat the condition report. Ask the contract to explain when the caução will be returned and what evidence supports deductions.
Do not treat normal wear as identical to tenant damage. If the landlord retains money, request an itemised written explanation.
Common misconceptions
One misconception is that caução and advance rent are the same payment. Portuguese contracts use them for different purposes. Another is that a Finanças record makes every clause legal. Registration cannot replace contract review.
It is also misleading to assume an informal agreement is safer because it is flexible. Missing terms and receipts usually harm the tenant when a dispute begins.
