How do rental contracts and deposits work in Belgium in 2026?

A deposit is not always legally mandatory, yet almost every private lease contracts one. Caps apply to base rent excluding charges.

In Flanders, the Vlaams Woninghuurdecreet (Flemish residential tenancy decree) limits the huurwaarborg (rental deposit) to three months' rent for covered principal-residence leases. In the Brussels-Capital Region, for leases entered into or renewed from 1 November 2024, the garantie locative (rental deposit) cannot exceed two months' rent under the Brussels Housing Code. In Wallonia, principal-residence and many student leases are capped at two months' rent following the 2023 update to the bail d'habitation (housing lease) rules.

Allowed forms commonly include a blocked individual account in the tenant's name, a bank guarantee, routes via CPAS / OCMW (the local public social welfare centre), and e-DEPO through the Deposit and Consignment Office of FPS Finance. Get a written lease stating parties, address, base rent, charges locatives / gemeenschappelijke kosten, deposit amount and form, duration, and how indexation works. Ask for the EPC / PEB (energy performance certificate) disclosure with the lease pack.

Complete a placebeschrijving / état des lieux (dated inventory of the property's condition) at the start. Flemish guidance expects this during the first month of the rental period. Register the inventory with the lease where the Region requires it.

In Flanders, the landlord must register the lease within two months after signing, often via MyRent or the local Rechtszekerheid (legal certainty) office. Registration is free. Nine-year principal-residence leases remain a common default pattern, while short-term, student and secondary-residence contracts follow different regional tracks. Do not copy a Flanders notice period onto a Brussels student lease.

Annual rent indexation, when allowed by the lease and regional rules, is often tied to the health index rather than a free renegotiation. Exact formulas and freeze periods change by Region and lease date, so read the indexation clause and the current regional calculator instead of inventing a percentage. Charges are settled separately from base rent and may be adjusted against real costs.
