Signing a Cyprus lease is not a handshake on Messenger. Deposit norms, Cap. 23 versus free-market rules, and electronic payment law decide whether banks, ARC offices, and District Courts treat you as a protected tenant.
What must the written lease include?
Use a clear written residential lease naming landlord and tenant IDs, exact address, start date, monthly rent, payment method, furniture status, deposit amount, notice rules, and who pays communal fees. Market deposits usually sit at one or two months’ rent. Luxury asks can climb higher, but three months of “deposit” with no inventory should slow you down. From 1 July 2026, Article 48A of the Assessment and Collection of Taxes Law requires rent for immovable property to move only by bank transfer, card, or another recognised electronic method. Cash rent is not a lawful fallback.
Cap. 23 rent control or free-market contract?
Cyprus runs a two-speed system. Buildings completed on or before 31 December 1999 in designated municipal areas can fall under the Rent Control Law (Cap. 23), with stronger security of tenure and statutory rent-rise limits. Newer buildings, and many coastal towers newcomers actually rent, usually sit under Contracts Law (Cap. 149) and the terms you negotiate. Ask when the building was finished before you assume “rent control protects me.”
For longer fixed terms, Cap. 149 practice expects a written lease signed with adult witnesses. Stamp duty on leases was abolished from 1 January 2026 under Law 239(I)/2025, so do not treat an old Tax Department stamp as the modern proof of validity. You still need the written contract itself for residence permit and ARC address evidence.
How do deposits, communal fees, and notice work?
Landlords may deduct unpaid rent, damage beyond wear and tear, and outstanding communal charges only when the lease assigns those charges to you. Photograph the flat and meters on move-in day. Notice periods are contractual on free-market flats, commonly one to three months depending on the text. Early exit without a break clause can leave you liable for remaining rent. Assuming every Cyprus flat is Cap. 23 protected fails for post-1999 towers.
Assuming stamp duty is still required in 2026 also fails. The stamp ritual ended; the written electronic-payment trail did not.
