Signing a Luxembourg lease is a cash event as much as a housing event. Garantie locative plus first rent and your half of any agency fee can dwarf one month of headline loyer before you unpack. Guichet.lu and the August 2024 residential-lease reform set the rules movers actually feel.

What belongs in the written bail?

Use a clear written bail (residential lease). For contracts concluded from 1 August 2024, Guichet and Logement.lu treat written form as mandatory; an oral deal from that date is null. The lease should state the parties, exact address, start date, rent excluding charges, payment frequency, whether charges are advances or a flat rate, furniture if any, the deposit amount if required, and that parties may refer rent disputes to the Commission des loyers (Rent Committee).

Confirm commune registration rights before you celebrate. The address on the lease is the one you take to the Bureau de la population; see Register your address. Search steps live in How to rent a home. Price context sits in How much is rent.

How do deposit, inventory and charges work?

The garantie locative may not exceed two months' rent. Guichet calculates that cap on rent, not on charges. Allowed forms include a blocked bank account, a bank guarantee, cash or cheque with receipt, a state-backed guarantee when you qualify, or insurance if the landlord accepts it. Prefer a blocked account or bank guarantee over informal cash. Open the banking piece through a Luxembourg account when the bank requires it.

If a deposit is required, Guichet says a move-in inventory must be signed no later than the day you take possession. Photograph every room. On exit, half the deposit returns within one month of handing back the keys when the inventories match and no rent is owed; the balance follows within one month after the final charges settlement or equivalent Guichet trigger. Late returns after formal notice can attract a monthly penalty equal to 10% of the monthly rent on Guichet's timetable.

Charges (avances sur charges) cover tenant-side consumption and building costs billed as advances, then settled. Budget guidance: Utilities, internet, and transport. For new leases from August 2024, agency commission is shared 50/50; a clause dumping the whole fee on the tenant is void.

How do notice periods usually work?

Guichet's termination pages treat three months' notice by registered letter with acknowledgement of receipt as the common tenant minimum unless the lease sets a longer period. When a landlord ends a lease for personal need, the notice period is six months. Co-tenancy (colocation) has extra replacement rules; read the Guichet joint-tenant sheet if you share a single lease. Do not invent shorter WhatsApp exits.

Common misconceptions

Older blog posts that still say a three-month deposit is normal are outdated for current leases. Guichet caps the deposit at two months' base rent.

"Charges included" also does not mean the winter bill is fixed forever. Advances settle, and electricity or internet may remain separate contracts.

Summary

Sign a written bail that states base rent, charges method, deposit amount and registration rights, then treat two months' base rent as the legal deposit ceiling and 50/50 as the agency-fee rule on new leases.

Photograph the flat at handover, keep payment proofs, and budget the two-stage deposit return as a real exit timeline, not fine print.
