South Korea lets renters trade monthly cost for deposit exposure. Jeonse is a large-deposit lease with little or no monthly rent. Wolse is monthly rent plus a deposit, while banjeonse is a hybrid lease with a substantial deposit and monthly rent. None makes the deposit bank-held or risk-free.
What should the lease say?
The contract should identify the legal owner, tenant, exact registered unit, residential use, term, deposit, monthly rent, payment dates, and account. It should allocate repairs, pets, subletting, early termination, restoration, utilities, and gwanlibi (monthly building management charge). Attach the broker's written property explanation, furniture inventory, meter readings, photographs, and any special clause barring new security interests before your protection is established.
The current Housing Lease Protection Act treats a residential term shorter than two years as two years for the tenant's protection, while allowing the tenant to rely on a shorter agreed term. The statutory renewal-request right can be used once, producing a two-year renewal, but the landlord has listed refusal grounds. The Act's ordinary ceiling on an increase is 5 percent, subject to the law's conditions and any lower local rule. Do not turn those protections into an informal promise. Give termination or renewal notices in traceable form and check the current Act for your facts.
Broker compensation is not one national flat percentage. The cap depends on the region, property classification, transaction value, and whether the deal is a lease or sale. An officetel (compact mixed-use studio building) can fall under different fee treatment depending on its facilities and size. Obtain the local fee table and written calculation before paying.
How do you establish deposit priority?
Three facts work together under Korean lease law: possession of the home, the legally effective address registration route, and hwakjeong ilja (the official fixed-date stamp used to establish deposit priority). A qualifying foreign resident does not blindly use Korean-citizen wording. Supreme Court decisions recognise foreigner registration and the correct change-of-residence report as the address element when completed under the immigration rules.
The fixed-date stamp helps set priority for repayment in an auction, but it does not erase earlier mortgages, seizures, tax claims, or other tenants' rights. A housing lease report, where applicable, records the contract and may connect with fixed-date processing. It is still different from possession, the address report, and a guarantee.
What protects return at move-out?
HUG (Korea Housing and Urban Guarantee Corporation, a public housing guarantee provider) offers a deposit-return guarantee for eligible contracts and homes. It reviews the contract, fixed date, occupancy records, payment evidence, property value, senior debt, building status, and other conditions. Check the live HUG product before signing and apply within its current window. A broker's prediction or app pre-check is not guarantee issuance.
At move-in, keep bank transfers and signed condition evidence. At move-out, send notice correctly, photograph condition, record meters, return keys against a receipt, and request an itemised statement for rent, utilities, damage, or management-charge deductions. Ordinary wear is not the same as tenant damage. Do not surrender possession or change the protected address before the deposit is returned without advice on preserving rights, such as a court leasehold registration order.
Common misconceptions
A fixed-date stamp is not deposit insurance, and HUG approval is not the same as address-based legal priority. South Korea layers these protections because each responds to a different failure: third-party ownership claims, ranking in enforcement, or the landlord's failure to repay.
