Portugal does not sell Dutch-style erfpacht as the default apartment story. The useful split is propriedade plena versus limited real rights recorded on the registo predial (land registry). English ads that say “freehold” can still hide a surface right, bare ownership, or heavy charges.
What should propriedade plena versus surface rights mean to you?
Propriedade plena is full ownership of the described property within Portuguese law. Apartment buyers still share roofs, lifts, and façades through propriedade horizontal and pay condomínio quotas: condominium fees. That shared building layer is not the same as a ground-lease clock.
Direito de superfície lets someone build or keep a structure on another person’s land for the period and conditions in the title. When the term ends, outcomes follow the constitutive deed and Civil Code rules, which can be very different from owning both soil and building forever. Older municipal or development schemes sometimes use surface rights, so a cheap asking price can reflect a thinner right: can foreigners buy property.
Other inscriptions to flag with your lawyer include usufruto (use and income for someone else), nuda propriedade (bare title), mortgages, attachments, and preferential rights. Do not skip this because the agent speaks English.
Which documents settle the question?
Order a recent certidão permanente from the property registry. The inscription wording should show whether you are acquiring ownership or a surface right, plus term and charges. The caderneta predial (tax matrix extract) helps with tax identity but is not the final word on right type when the registry says otherwise.
Your independent Portuguese lawyer should match registry, tax matrix, energy certificate, condominium debt letters, and the promissory contract before the deed. Banks pricing a foreigner mortgage will also care what right they can take as security.
Closing cash for transfer tax and deed costs belongs in a separate budget: use property purchase costs rather than freezing one year’s IMT brackets into memory. You will need a NIF for tax and deed steps.
Common misconceptions
Calling a flat “freehold” does not override the registo predial. If the certidão says surface right, that is what you buy.
Owning an apartment also does not remove condomínio duties. Full unit ownership still sits inside horizontal property rules and extraordinary works votes.
