Indonesia uses freehold and leasehold labels in ways that confuse newcomers used to Western condo freehold. The certificate at Badan Pertanahan Nasional (BPN) matters more than the English brochure.
What does freehold mean in practice?
Hak Milik is the strongest personal ownership title and is generally reserved for Indonesian citizens. Foreign individuals are not the normal Hak Milik holders. Marketing that promises “freehold villa ownership” for a passport holder usually hides a nominee risk or a different title structure. Nominee shortcuts that put Hak Milik in an Indonesian friend’s name for you remain a common Bali scam vector: Can foreigners buy property.
Hak Pakai (right to use) is the personal title path most often discussed for qualifying foreigners on houses or apartments under published ATR/BPN rules, typically tied to lawful stay and property thresholds. It is multi-decade right-to-use, not identical citizenship-style freehold. Hak Guna Bangunan (HGB) is a right to build commonly used for apartments and company-held projects; PT PMA structures may hold HGB for investment cases with full corporate compliance.
How does leasehold work for villas and land?
Long-term leasehold (Hak Sewa) lets you contract use of land or a villa for a fixed term, often marketed in Bali as 25- or 30-year leases with optional extension language. The lease is only as strong as registration, remaining years, zoning, and the lessor’s actual title. Verbal renewal promises are weak. Independent notary and title checks belong in every serious file: Property purchase costs.
Apartment buyers still face ongoing IPL building fees after any title closes: Condominium fees. Bank lenders that finance foreigners usually want HGB or other bankable certificates, not thin lease narratives: Foreigner mortgage. Renting first still solves many mover months without title risk: How to rent a home.
Common misconceptions
Assuming English “freehold” equals Hak Milik in your name fails for most foreigners.
Assuming a long Bali lease automatically renews for another 30 years also fails without a registered, reviewed renewal path.
Summary
Treat Indonesian freehold as Hak Milik for citizens, and treat foreign access as Hak Pakai, HGB, or leasehold with a lawyer reading the certificate. Do not pay on brochure language alone.
