French “rent control” talk mixes two tools. One limits rent rises when a home is re-let or a bail renews in most zone tendue communes. The other caps the base rent level against official reference rents in a shorter list of experiment cities.
Where do reference rent ceilings apply?
Service-Public lists the communes that apply encadrement du niveau des loyers. In Île-de-France that includes Paris plus Est Ensemble and Plaine Commune territories. Outside Paris it includes Bordeaux, Lille with Hellemmes and Lomme, Lyon and Villeurbanne, Montpellier, named Pays Basque agglomeration communes, and parts of Grenoble-Alpes Métropole.
Inside those addresses, the base rent excluding charges and excluding any lawful complément de loyer cannot exceed the loyer de référence majoré in force on the signing date. Ads and the bail must show the reference, majoré, and minoré figures. A complément de loyer is allowed only for exceptional features and follows its own Service-Public rules; it is not a free way to ignore the ceiling.
HLM social stock, many Anah-conventioned homes, loi 1948 homes, tourist meublés, and ordinary sous-locations follow other rules. Run the official commune simulator before you assume your street is capped: How much is rent in France.
How do zone-tendue rent-rise limits work?
In most other zone tendue communes, owners cannot freely jump the rent between tenants or at renewal. Rises follow the limited cases Service-Public lists, for example when qualifying works were done. That evolution control is renewed by decree on a rolling basis and is separate from the reference-rent experiment.
Annual reviews on a sitting bail still follow the written clause and the IRL (rent reference index) path, not a free WhatsApp increase: Rental contracts and deposits. Compare furnished and empty ads carefully, because furnishing changes deposit and term rules even when the same street sits under a ceiling: Furnished rentals.
If an advert or draft bail ignores a published ceiling in Paris, Lyon, or Bordeaux, push back in writing and keep screenshots. Owners who break level control can face administrative fines. For the search file and viewing checks, use How to rent a home and Tenant rights.
Common misconceptions
Zone tendue alone does not mean every street has a euro-per-square-metre ceiling. Many tendue communes only limit rises between contracts.
A complément de loyer line does not make every over-ceiling ask legal. It needs exceptional features and correct disclosure.
Summary
Check your exact commune on the Service-Public tools first. Treat Paris, Lyon, Bordeaux, Lille, Montpellier, and the named experiment territories as level-capped markets, and treat other zone tendue addresses as rise-limited markets. Read the bail figures against the current arrêté before you sign.
