China counts stay days from the visa, stay permit, or residence sticker in your passport. When that date passes, you are not in a grey tourist zone. You are in illegal residence under Exit-Entry rules, and border inspection can discover it when you try to leave.
What does the law allow authorities to do?
Article 78 of the Exit and Entry Administration Law says foreigners who illegally reside may receive a warning; where circumstances are serious, the penalty is ¥500 for each day of illegal residence, with a total fine not exceeding ¥10,000, or detention of five to fifteen days. A National Immigration Administration enquiry reply has explained practical bands that treat very short first overstays as warning territory and longer or repeat overstays as fine or detention territory, with the daily fine counted from the eleventh day in that reply’s framing. Individual cases still turn on local Exit-Entry facts, so treat the statute and NIA guidance as risk maps, not a do-it-yourself sentencing chart.
Illegal residence also includes visa-free visitors who pass the visa-free limit without a stay document, and people who leave the area their stay permission allows. Working without the right permit is a separate illegal-work problem on top of stay dates.
How do you avoid the problem?
Diary the end date the week the sticker or visa issues. For short stays, file an extension before expiry: Extend stay. For residence permits, start renewal about 30 days early with employer, school, or family papers still valid: Renew a residence permit. If your purpose changed, do not wait for overstay and then invent a story; file a status change while you are still legal: Change status of residence.
Keep temporary address registration current so Exit-Entry filings are not blocked by an old hotel form: Register address. If you already overstayed, contact the local Exit-Entry Administration promptly rather than hoping the airport will ignore the passport page. Penalties and onward visa risk are better handled at the desk that owns your file than at the boarding gate. Mandarin-only windows are common: Chinese bureaucracy without Chinese.
Common misconceptions
Assuming a pending job offer freezes your stay clock fails. Only Exit-Entry ink extends legal stay.
Assuming a one-day overstay is always free also fails. The law starts with a warning tool and escalates for serious or longer cases; do not plan around a hoped-for warning.
Summary
Treat visa and residence end dates as hard stops. Extend or renew while you are still legal, and understand that Article 78 allows warnings, daily fines up to ¥10,000, or short administrative detention when illegal residence is found.
